GENERAL BUSINESS TERMS AND CONDITIONS

  • 1.General information

    All services rendered for the customer by the online shop are realised exclusively on the basis of the following general terms and conditions. Any terms deviating from these are only valid if they have been agreed in writing between Micro Mobility Systems Ltd. and the customer.

  • 2.Conclusion of contract

    • 2.1The goods and services offered by the online shop on the internet represent a non-binding invitation for customers to order merchandise in the online shop.

    • 2.2Submission of an order by the customer for the requested merchandise on the internet shall constitute a binding offer for concluding a purchase contract.

    • 2.3Micro Mobility Systems Ltd. is entitled to accept this offer within two calendar days by sending an order confirmation by e-mail. The offer is deemed as rejected if the 2 day period expires with no action being taken.

  • 3.Delivery times

    All items will be delivered immediately, provided they are in stock. Delivery is only realised within Switzerland. For deliveries abroad, please contact our responsible partners (see www.micro.ms for further information in this respect). The delivery time is usually up to 5 working days. Should an item not be available at short notice, we will inform you of the anticipated delivery time by e-mail if you have provided us with your address. No claims for damages may be made against us in the event of delivery delays caused by circumstances such as force majeure, traffic disruptions and decrees issued by public authorities, or any other events for which we are not responsible.

  • 4.Packaging and shipping costs

    No additional charges will be levied for packaging and shipping costs. We deliver free of charge throughout Switzerland.

  • 5.Payment

    All prices quoted are final prices and include the current statutory value added tax of 7.6%. Payment is only possible by invoice. Payment of the invoice amount is due within 30 days of receipt of the merchandise. We will bill dunning charges of CHF 20.- if this deadline is not observed. We reserve the right to instigate a collection of the claim if payment is not effected with 3 days of this reminder. The merchandise delivered remains our property until complete payment has been realised.

  • 6.Right of return

    Unused items can be returned in their undamaged original packaging within 5 days of delivery. The costs of the return delivery are borne 100% by the purchaser. Please contact us prior to returning a delivery.  Utilise our address stipulated below for your shipments. Items which have been manufactured or modified specially for you cannot be taken back.

  • 7.Right of withdrawal and consequences thereof

    Information about your right of withdrawal from the contract and the consequences thereof is included in an annex and considered an integral component of these general business terms and conditions.

  • 8.Warranty

    Should it be determined that the goods have been damaged during transportation, the recipient should report the damage immediately to the carrier (shipping service). Other recognisable transport damage should be reported to us in writing within 3 days of receipt of the goods at the latest. We bear no liability for defects that occur as a result of incorrect handling, normal wear and tear or external factors. Any warranty claim shall be invalidated by repairs to the goods realised by the customer or by a third party without our prior written consent.

  • 9.Limitation of liability

    The seller bears liability in all cases, including commercial business transactions, if it has caused damages through intentional or grossly negligent behaviour.
    Unless otherwise specified in the following, any further legal claims of the purchaser are excluded, irrespective of the legal basis involved. Micro Mobility Systems Ltd. therefore bears no liability for damages not caused to the delivery item itself. In particular, Micro Mobility Systems Ltd. does not bear any liability for loss of profit or any other pecuniary loss to the purchaser. In as far as the liability of Micro Mobility Systems Ltd. is excluded or limited, this shall also apply to the personal liability of employees, representatives or vicarious agents of Micro Mobility Systems Ltd. The abovementioned liability restriction shall not apply to any claims exerted by the purchaser under the Product Liability Act (Produkthaftungsgesetz), claims relating to the absence of guaranteed attributes or claims for compensation because of non-performance.

  • 10.Data protection

    The data transmitted by you will be used exclusively for the processing of your orders. All your data will be handled by us in strict confidentiality. Data will only be passed on by us to third parties (e.g. shipping agents) if this is necessary for the processing of your order. Order data is encrypted and transmitted securely. However, we do not accept any liability for data security during transmission via the internet (e.g. due to technical errors on the part of the provider) or for any possible criminal intervention by a third party enabling access to files on our website. Access data for the customer login which is transmitted to the customer on the request of the latter should be treated by the customer in strict confidentiality, as we bear no responsibility whatsoever for the use and application of this data.

  • 11.Copyright

    All external logos, images and graphics displayed are the property of the respective companies and are subject to the copyright of the corresponding licensor. The copying or use in any other way of all photographs, logos, texts, reports, scripts and program routines shown on this website is prohibited without our permission, regardless of whether they are our own developments or prepared by us. All rights are reserved.

  • 12.Miscellaneous

    No damages may be claimed against us for items which can no longer be supplied. We reserve the right to change the price of individual items.

  • 13.Validity of general business terms and conditions

    The general business terms and conditions of Micro Mobility Systems Ltd. are deemed to be recognized on placement of an order. In the event of a provision of these general business terms and conditions proving invalid for any reason whatsoever, the validity of the remaining provisions shall remain unaffected. Verbal agreements require confirmation in the written form. In the absence of any other agreement, the place of fulfilment and place of jurisdiction is Kuesnacht ZH.

    Annex: Notification relating to the right of withdrawal

    Right of withdrawal:

    You may revoke your contractual agreement in writing (e.g. letter, fax or e-mail) within two weeks (with notification prior to conclusion of contract) without stating any reasons or by returning the merchandise. The expiration period begins with the receipt of this notification. The timely despatch of the revocation or the merchandise shall be deemed sufficient for compliance with the revocation period.

    Consequences of withdrawal:

    In the case of an effective revocation, the mutually received goods or services shall be returned and any benefit derived from said (e.g. interest) shall be surrendered. In the event of you being unable to reimburse us either in total or in part for services received, you are required to pay us compensation of equal value. In the case of items provided for use, this does not apply if the deterioration of the item is exclusively due to its being inspected, as would, for example, be possible in a shop. In other respects, you may avoid the obligation to compensate for the value by not using the item as if it was your own and by refraining from undertaking anything that reduces its value. In the case of return of goods from a delivery, you are obliged to bear the costs of the return delivery.
